1. Acceptance of Terms

By accessing or using the OnePremium platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and OnePremium GmbH ("Company", "we", "us", or "our").

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into contracts in your jurisdiction. By using the Platform, you represent and warrant that you meet these requirements. Users from jurisdictions where cryptocurrency transactions are prohibited are not permitted to use our services.

3. Description of Services

OnePremium provides a blockchain-based token ecosystem on the Ethereum network. The OPM token is an ERC-20 utility token that provides access to tier-based benefits, partner discounts, and governance participation. The Platform includes wallet connectivity, portfolio tracking, and token management features.

4. Token Characteristics

The OPM token is a utility token and does not represent equity, debt, or any ownership interest in OnePremium GmbH. Token holders do not have voting rights in corporate matters, dividend rights, or claims to company assets. The token provides access to platform features and partner benefits only.

5. Risk Acknowledgment

You acknowledge that cryptocurrency investments involve substantial risk of loss. Token values are highly volatile and may decrease significantly or become worthless. Past performance is not indicative of future results. You should only invest funds you can afford to lose entirely.

6. Lock Period

Tokens acquired through the Platform are subject to a 365-day lock period from the date of receipt. During this period, tokens cannot be transferred or sold through the Platform. This mechanism is designed to encourage long-term holding and ecosystem stability.

7. Prohibited Activities

You agree not to: (a) use the Platform for money laundering or terrorist financing; (b) circumvent any security measures; (c) use automated systems to access the Platform; (d) impersonate others; (e) engage in market manipulation; (f) violate any applicable laws or regulations.

8. Intellectual Property

All content, trademarks, and intellectual property on the Platform are owned by OnePremium GmbH. You are granted a limited, non-exclusive license to access and use the Platform for personal, non-commercial purposes. You may not copy, modify, or distribute any content without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, OnePremium GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or tokens. Our total liability shall not exceed the amount you paid for tokens in the preceding 12 months.

10. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Berlin, Germany. You consent to the exclusive jurisdiction of these courts.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via the Platform or email. Continued use after changes constitutes acceptance of the modified Terms.
